Sexual Offences Limitation Periods in France: 2025 Reform Explained
(Insights from a French Criminal Lawyer)
A Reform That Changes the Rules of the Game
As of July 2025, the French Penal Code has undergone major reforms to the statute of limitations for sexual offences.
Until now, limitation periods varied depending on the seriousness of the offence and the victim’s age. The new law significantly strengthens protection for victims, particularly when they were minors at the time of the offence.
Some offences are now virtually imprescriptible, meaning they can be prosecuted decades after they occurred.
Offences Covered by the New Rules
This reform applies not only to rape (for which we have a detailed analysis here 🔗) but also to a wide range of sexual offences :
- Sexual assault (with or without penetration)
- Sexual offences against minors (with or without violence)
- Sexual harassment
- Corruption of a minor
- Sexual exhibition
- Pimping involving minors
2025 Limitation Periods in France
Under the new rules
:
- Rape is now subject to a limitation period of 20 years after the offence if the victim is an adult, and 40 years after reaching adulthood if the victim was a minor.
- Sexual assault now has a limitation period of 6 years for adult victims and 30 years after majority for minors.
- Sexual harassment’s limitation period has been doubled, now standing at 10 years.
- Corruption of a minor can be prosecuted for up to 30 years after the victim’s majority.
- Sexual exhibition involving minors also benefits from extended limitation periods.
Why This Matters for Victims
- More time to speak up: Many victims disclose the offence only in adulthood, sometimes decades later.
- Alignment with psychological realities: Studies show trauma can delay disclosure by 20–30 years.
- Institutional recognition: Longer limitation periods show a political will to ensure justice is not erased by time.
Impact on the Accused
This reform also affects the rights of the defence :
- Evidence challenges: The longer the time, the harder it is to gather proof.
- Extended legal risk: Allegations can hang over a person for decades.
- Need for early legal counsel: Consulting a criminal lawyer early can be a strategic safeguard.
The #MeToo Effect
This reform is part of a broader cultural shift sparked by the #MeToo movement.
Since 2017, sexual offence cases in France are more likely to be investigated and pursued :
- Judges take delayed testimony more seriously.
- Investigations open more readily.
- Public opinion indirectly influences procedural speed.
What to Do If You Are Involved
- Victims: Consult a lawyer immediately to verify the exact limitation period in your case.
- Accused persons: Never respond alone — legal guidance is essential, even if no formal charges have been filed yet.
